This is the user agreement that is governed in accordance of the law of England for your use on this Website and the purchase by you of the services and products we provide. If you do not agree to be bound by these terms and conditions, you may not use or access our Website.
It is strongly recommended that you take time to read these terms and conditions it is important for both you and Chelsea FC Auctions that you understand our contractual relationship relating to your use of this site and your obligation as a member. We will not allow you to purchase any products from this site unless you have confirmed that you have read these terms.
Definitions and Interpretations
In these terms and conditions, unless otherwise specified or inconsistent with the context, the following definitions will apply:
"Chelsea FC Auctions" means the website name and the operating auction name, but will also be referred to as "FANS.UK.NET LTD" the registered trading name and owner of Chelsea FC Auctions and therefore all copyrights are reserved. Trademarks and brand name are used under a license agreement.
Auction payment security and protection.
Due to security risks and credit card fraud prevention, we do reserve the right to approve only countries which we believe to be of limited risk to our payment channel. If you are unable to register because you are not eligible to join due to your country of residence, you will be denied access to bid on any items.
The approved countries have been carefully selected by the board of Fans.UK.Net Ltd and on legal advice to protect the integrity of the auctions and the charities. We may from time to time review the security risks of approved countries and should you wish to enquire if your country is approved, you can do so by contacting us at admin@chelseafcauctions.com. Please note that although Paypal may approve or allow you to register an account with them as a method of payment, this will not mean you will be eligible to register with Chelsea FC Auctions.
1.0 Membership Selection
Our membership is open to all Chelsea FC supporters worldwide and we do not intend to discriminate against any person(s) who sees fit to join this community as we aim in connecting all Chelsea FC supporters. You are responsible for selecting a suitable user ID and password and to ensure you make every effort to conceal such sensitive information from any third party directly or indirectly and you should make every effort to contact our customer services at admin@chelseafcauctions.com should you suspect a security breach. Membership is offered by subscription.
Once you have registered to a full paid subscription, you will enjoy the benefits to bid on as many products you are prepared to purchase, a free webmail with username@chelseafcauction.com, postage and packaging on all items paid worldwide, a weekly newsletter providing members and fans experience of Chelsea FC Auctions, events for winners, products available, special and unique items and auction announcements. The subscription allows the auction to prevent fraudelant intent of users registering and provides a secure and trusting environment for it's members.
We reserve the right to alter the subscription fees from time to time to meet the demand and development of the community, should this apply we will notify you within 28 days and the new fees will apply at your renewal date. The features offered on your membership are for the use and purpose of Chelsea FC Auctions, we may alter, upgrade and add features during your membership and this should not affect the overall performance of your membership or fees paid, please be aware that any abuse of these features may result in suspension of your membership. We also reserve the right to refuse anyone membership if we suspect you knowingly to submit false personal details or attempt to commit fraudulent intent against Chelsea FC Auctions, we will report this to the authorities and take legal action.
1.1 Subscription Cancellation
On registration your membership will only include features to bid for auction merchandise once you pay the full subscription fee, otherwise you will only be allowed to browse in the shop. Your subscription fee is a contract between you and Fans.UK.Net Ltd who wholly provide this auction service for Chelsea FC.
This contract is your acceptance of the terms and conditions and this does not affect your statuary rights to cancel your membership, although this membership does not offer any form of refund once membership has commenced, if you should wish to cancel your subscription within the first 14 days of registration and you have not bid on any items, Fans.UK.Net will issue a full refund on these conditions only.
Should you not wish to renew your subscription, you should notify the admin team 14 days prior to the renewal date at admin@chelseafcauctions.com, should you fail to notify us within the agreed period your membership will continue without the right to cancel. We will endeavour to assist any member with difficulties when subscribing, but due to the charges of the transaction(s) refunds will not be made under any circumstances.
1.2 Our Website
Chelsea FC Auctions is the official auction website of Chelsea FC and a registered domain name owned by Football Auctions Network Services UK a registered company operating under the name of Fans.UK.Net Ltd. You can access this website at www.chelseafc.com and www.fans.uk.net.
1.3 Official signed Merchandise
Chelsea FC Auctions will provide weekly live auctions offering official merchandise exclusively supplied in partnership with Chelsea FC and signed by the playing staff, a registration for every item will be retained by Chelsea FC Auctions with the owners personal details. This information will remain the property of Chelsea FC Auctions and Chelsea FC.
All items will be dispatched after payment is received at auction end within 28 days, deliveries are made by courier at no additional cost. Chelsea FC Auctions are solely responsible for dispatching our products and no other products from third party sources.
IMPORTANT NOTE: PLEASE DO NOT CONTACT US REGARDING A PURCHASE IF THE TIME EXPIRED SINCE PAYMENT IS LESS THAN 28 DAYS AS THESE EMAILS WILL NOT BE ANSWERED.
We are unable to guarantee the frequency of various products offered on the auction, as the supply is determined by Chelsea FC and therefore we will not reply to any requests for a particular product. We will issue a unique certificate of authenticity which includes documentation of ownership with every product sold and all transaction information will be retained on our database for the benefit of Chelsea FC Auctions and Chelsea FC. The profits from the proceeds of all auctions will be donated to Clic Sargent the official charity of Chelsea FC.
1.4 Liability and Indemnity
It is our intention to provide all members an open auction to buy products in good faith and in the spirit of becoming of a Chelsea FC supporter and we will endeavour to do our utmost that this is maintained. Chelsea FC Auctions or Chelsea FC cannot be held liable for any products purchased outside this official auction website and therefore cannot be held liable to provide authenticity of such product, as it will not be deemed an official product of Chelsea FC so this will indemnify Chelsea FC Auctions of such, as any claim can only be verified if the product is purchased from the auction and the relevant documentation provided corresponds with the unique identification number supplied at the end of auction.
Chelsea FC Auctions will take every necessary step if members act improper or are infringement of our terms, to revoke their membership and refuse that individual(s) use of the Website. 1.5 Buying
You agree to and are under legal obligation, as stated in the terms of this auction to complete the purchase of the product you have successfully bidded on should you be declared the winner when the auction ends. A legal contract will be formed to complete the transaction by email and payment for all items purchased must be received within 7 working days of auction end. If payment is not received within 7 working day period a £25.00 administration charge will be levied to complete the purchase and a new notification will be issued, you may also lose the right to complete the purchase and the item may at our discretion be relisted on the auction. Failure to adhere to the terms of the auction could result in serious sanctions which include suspension of your account to bid for other items indefinitely. Any attempt to register under a new identity will impose an IP ban from entering the website and will be blacklisted on a seperate database. If you have any concerns you must contact the admin team.
You agree not to purchase merchandise from the auction to engage inappropriately or misuse the product or resell by claiming to be an official supplier of such products, as this website is the only recognised official supplier of signed merchandise, if you fail to agree to these terms you will not be allowed to bid for any items and you will be reported to Chelsea FC.
You undertake to us that the details you give to us while using this site are correct in particular that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the products and that you submit to operating a paypal account which can be registered free of charge at www.paypal.com as you will require a paypal ID for your transactions. Paypal reserve the right to refuse you from registering with them depending on the country of residence and therefore you will be required to use the secure credit card service operated on Chelsea FC Auctions.
If there are any profile changes to the details supplied to us by you it is your responsibility to update or inform Chelsea FC Auctions via our web or by contacting our Customer Services as soon as possible.
1.6 Personal Details
We will take every possible measure to ensure your details are not distributed or made available to third parties. Please refer to our privacy policy.
We will do our best to correct errors and omissions as quickly as practicable after being notified of them. However because of the technology that is required in operating this Website there may be times when obvious errors occur.
1.7 Emails
Chelsea FC Auctions will not contact members to obtain or confirm your personal details and passwords and will protect our members from such spam mail, you must advise us if any such breach occurs or we will be unable to take any action.
1.8 Appeals
We offer an appeal system for any member whom may feel aggrieved from expulsion on our website and we will consider any such appeal if that member can provide evidence to support any submission which does not fail any of the terms listed above. This should be submitted to our customer services admin@chelseafcauctions.com, you have 14 days from your account being suspended to do this and you must allow 14 days from the date of submission for a reply which will be forwarded as a correspondence to your listed email address.
Any decisions are made at the discretion of Chelsea FC Auctions and our decision is final, but we may under certain agreement activate a members account after a 3 month review.
1.9 Refunds policy
We hope that you are pleased with your purchase from Chelsea FC Auctions. However, we understand that there are occasions when you may need to return goods to us for the following reasons.
If your goods are faulty on arrival, you have 28 days to inform us of the fault. When the goods are returned to us and the fault has been verified, we’ll issue a full refund to you via your original payment method, unless the product can be replaced.
If your goods were damaged in transit, we request that you report it to us within 7 days. If goods are visibly damaged on receipt, its best to sign the delivery note accordingly. Once the damaged goods are received back into our warehouse, we’ll issue a full refund to you via your original payment method.
2.0 Postage & Packaging
Chelsea FC Auctions make every effort to ensure your product is packaged suitably and securely, dispatched by our contract couriers to your registered address.
Due to the value of the product(s) we have taken every precaution to ensure no tampering or interference occurs to the package once dispatched, we therefore use security tags and tape on the packaging, using the Fans.UK.Net brand name and logo as our identity and authentication, you should not find any other wrapping or security tags on the package, but should you find these security tags broken or tampered with or even replaced you must report this to Chelsea FC Auctions, by either email at admin@chelseafcauctions.com or telephone our customer services on 0870 4113267 immediately or within 24 hours, please also make the courier aware of this security breach and record this on the delivery note prior to acceptance. If you are still unsure what to do then contact us for guidance.
If you are the auction winner please ensure you read the important information provided by email when completing your purchase, as we cannot be held responsible if you ignore any instructions that ensure the safe receipt of all the documentation supplied.
2.1 Product Options
Chelsea FC Auctions include a special service to have the shirts framed and footballs mounted in a display case, the products offered are of a very high quality and offered by a professional company. These options are offered at the end of an auction when you are in the payment screen and if selected it will be at an extra charge, full details of the options and prices are given before you complete your transaction.
2.2 How to pay
A link will be sent by email as confirmation of your purchase which is also a legal contract between you and Chelsea FC Auctions,you will have 7 working days to complete the purchase or a levy for additional admin costs may be added without exceptions. Once you have clicked the link or logged on to your account, you must go to "My Account" and then "My Bids" your winning bid will display in the list with the icon "Pay Now" click onto this link and a secure site will appear after your method of payment is selected.
